GENERAL CONDITIONS OF SALE
These general conditions of sale (hereinafter only "General Conditions") govern the sale of products marketed and viewable at the time of ordering at the address https://www.calzatureparutto.it/ powered by PARUTTO COMMERCE SRL
All product purchase contracts concluded through the website https://www.calzatureparutto.it/ powered by PARUTTO COMMERCE SRL and according to the procedures indicated therein, between the supplier and the customer, will be governed by these General Conditions. Products purchased on https://www.calzatureparutto.it/ are sold directly by PARUTTO COMMERCE SRL with registered office at Via Evangelista Torricelli 26 31021 Mogliano Veneto (TV), VAT number 05568160260 registered in the Company Register - REA VE-231667z

A. OBJECT OF THE ONLINE CONTRACT AND ITS DEFINITION
For the purposes of these general conditions of sale on this site, the following terms shall have the meaning indicated below:
- An "online" sales contract means a distance contract, i.e., a legal transaction involving movable goods and/or services entered into between a supplier, PARUTTO COMMERCE SRL, with registered office at Via Evangelista Torricelli 26, 31021 Mogliano Veneto (TV), VAT number 05568160260, and the Customer within the framework of a distance selling system organized by the supplier, which, for this contract, uses the remote communication technology known as the "Internet." All contracts, therefore, will be concluded directly through the end consumer/customer's access to the website https://www.calzatureparutto.it/. Following the indicated procedures, the contract for the purchase of the goods will be concluded;
- Customer means the natural or legal person who purchases goods and services from PARUTTO COMMERCE SRL
- By products we mean all products and/or goods and/or services marketed by the Company on this site;
- By site we mean the set of web pages within https://www.calzatureparutto.it/
- An order means the Customer's completion of all the operations indicated on the site aimed at purchasing the products as indicated on the site itself;
- “Order Confirmation” means the communication sent by the Supplier to the Customer following receipt of the order which constitutes acceptance of the contractual proposal and marks the completion of the online sales contract;
- The following are the terms and conditions of sale, which will remain in effect until modified by the supplier. Any changes to the terms and conditions of sale, which are always possible, including those related to regulatory changes, will be effective from the moment they are published on the website and will apply to sales made from that moment on.
B. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
- The contract stipulated between PARUTTO COMMERCE SRL and the Customer shall be deemed concluded and binding on both parties upon acceptance, even partial, of the order by PARUTTO COMMERCE SRL. PARUTTO COMMERCE SRL reserves the right, at its sole discretion, to accept or reject the Customer's order. Confirmation of the order, even partial, will be sent by PARUTTO COMMERCE SRL via email to the email address provided by the Customer. By placing an order through any of the available methods, the Customer declares having read all the information provided during the purchase process and fully accepting the general conditions published on the website at the time of ordering;
- The Customer is excluded from any right to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order;
C. PURCHASE METHODS, PURCHASER'S OBLIGATIONS AND SELLING PRICES
- The Customer may only purchase products listed in the electronic catalog at https://www.calzatureparutto.it/ at the time of placing the order, as described in the relevant information sheets. The technical information provided on the site faithfully reproduces that of the manufacturers of the goods included in the catalog. PARUTTO COMMERCE SRL, therefore, reserves the right to modify/adapt the technical information of the products to match that provided by the manufacturers, without prior notice. It is understood that the accompanying image may not be perfectly representative of the product's features and may differ in color, size, and accessory products shown. All information supporting the purchase (size guide, etc.) is intended as simple general information and does not refer to the actual characteristics of each individual product;
- In the event of acceptance of the order, the email referred to in point B no. 1 will contain the order execution date and a 'Customer Order Number', to be used in all further communications with PARUTTO COMMERCE SRL;
- The message contains all the data entered by the Customer who undertakes to verify its correctness and to communicate any corrections promptly;
- The Customer undertakes to provide accurate, truthful, and complete information in the process required to initiate the execution of this contract and any subsequent communications. Personal information and email address must be exclusively the Customer's and not those of third parties. The supplier reserves the right to prosecute any violation or abuse. The customer elects domicile at the address indicated on the digital form. By entering their telephone number, fax number, and email address, the customer consents to the supplier's use of these communication systems.
- In the event of non-acceptance of the order, PARUTTO COMMERCE SRL undertakes to promptly notify the Customer by sending an email to the address indicated by the Customer.
- All product prices displayed and indicated on the website are expressed in euros and include VAT and any other taxes (unless otherwise indicated). Shipping costs are the responsibility of the customer, as further specified in subsection H. PARUTTO COMMERCE SRL reserves the right to change prices at any time without notice.
D. PRODUCT AVAILABILITY
- The Customer may purchase the products listed on the website www.calzatureparutto.it in the quantities available in stock. Since the simultaneous access of many users and the simultaneous possibility of online orders affect product availability, PARUTTO COMMERCE SRL cannot guarantee the certainty of allocation of the ordered goods. PARUTTO COMMERCE SRL will notify the buyer whether or not the product will be available in the future and the expected time for procurement. In any case, the allocation and shipment of the goods are subject to payment for the goods themselves according to the methods established below;
E. PAYMENT METHODS
Payment for goods may be made by advance payment by credit card, bank transfer or via “Paypal”;
F. PRICE PAYMENT AND INVOICES
Prices are expressed in Euros (€) and include the applicable Value Added Tax (VAT) for the respective product categories. Any additional customs clearance charges will be borne exclusively by the recipient. Payment must be made at the time of ordering, with advance payment by credit card, bank transfer, or PayPal. Invoicing requests must be made at the time of ordering. Once the customer has received confirmation of their purchase, they must send an email to our customer service ( shop@calzatureparutto.it ) indicating:
- Order number;
- Company name;
- Billing address;
- Tax code and/or VAT number;
The document will then be sent to the applicant in digital format via email. Invoicing requests made within the days following the order acceptance date will not be accepted.
G. DELIVERY METHODS
- Delivery of products purchased from PARUTTO COMMERCE SRL can take place to any international destination;
- For each order placed on www.calzatureparutto.it PARUTTO COMMERCE SRL issues a receipt and a packing slip for the shipped material;
- PARUTTO COMMERCE SRL will deliver the selected and ordered products to Customers using trusted couriers and/or shipping agents;
- Orders are generally delivered within 30 working days of the order date (weekends and holidays are not included in delivery times). However, since order delivery is subject to payment by the Customer, delivery times may vary depending on the payment method chosen by the Customer when placing the order.
- The aforementioned times refer to products in stock at the time of ordering. Delivery will be made by the courier exclusively to street level. The supplier cannot be held liable for delayed or failed deliveries due to force majeure, traffic conditions, general road conditions, acts of the authorities, or unforeseeable circumstances.
- Standard delivery, via a trusted courier and/or shipping agent, unless otherwise agreed in writing between the parties, will be based on the daily delivery schedule established by the designated courier, Monday through Friday, excluding holidays. Evening deliveries, from 6:00 PM to 9:00 PM, or Saturday morning deliveries may be scheduled for some regions.
- In any case, the times indicated as delivery terms cannot be considered binding for PARUTTO COMMERCE SRL, therefore PARUTTO COMMERCE SRL cannot be held responsible in the event of delays in processing the order or in the delivery of the ordered goods;

Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages delivered corresponds to that indicated on the delivery note;
- that the packaging is intact, not damaged, not wet or, in any case, altered, including the sealing materials (adhesive tape or metal straps);
Any damage or discrepancy in the number of packages or information must be immediately reported to the courier making the delivery, by writing "withdrawal with reservation" on the accompanying document and confirmed within seven days by registered mail with return receipt to PARUTTO COMMERCE SRL Via E. Torricelli 26 - 31021 Mogliano Veneto (TV);
- Even if the packaging is intact, the goods must be inspected within seven days of receipt. Any hidden anomalies must be reported in writing via registered mail. Any reports received after the aforementioned deadlines will not be considered.
- For each declaration, the customer assumes full responsibility for what is declared;
- Once the courier's document has been signed, the Customer will not be able to raise any objections regarding the external characteristics of the goods delivered;
H. SHIPPING COSTS
Shipping costs are the sole responsibility of the customer and will be added each time, as indicated in the order process. Shipping costs vary depending on the country to which the order is being delivered.
All Customer orders will be delivered to the shipping address specified at the time the order is placed.
The Customer acknowledges that the Seller may deliver a smaller quantity of goods (in terms of number of items or models) than indicated in the Order. In such an event, the Customer agrees that, except in cases of willful misconduct or gross negligence on the part of the Seller, the Customer's sole remedy is the non-debiting of the non-delivered goods (or a refund if the charge has been made). The Customer has no right to refuse delivery, terminate the relationship, or request compensation for any damages. Partial shipments are permitted, provided they are within the confirmed delivery deadline.
Products are delivered within Italy, to the address indicated by the Customer and with the courier available at the time of checkout, between GLS and DHL.
The Customer will receive an email from the Seller informing them of the order's completion, i.e., the courier's receipt of the package. Once the goods have been collected by the carrier, all communications regarding delivery will be made exclusively between the Customer and the supplier.
The delivery date for the goods is intended as an estimate but not binding for Negozi Pellizzari. From the time the courier receives notification of acceptance, deliveries to the mainland can take 3 to 5 days, and up to 10 days for deliveries to islands or remote areas, except in cases of force majeure.
Delivery within Italy costs €5.00 for all orders with a product subtotal of less than €100.00.
Delivery is free for all orders with a product subtotal of €100.00 or more.
Delivery costs within Europe vary depending on the destination country; rates range from €15 to €20, except for Great Britain and Switzerland, where the cost is €35.
Deliveries are also made outside of Europe at a cost starting from €70.00.
Once the goods have been received in the appropriate box, the Customer must verify that it has not been tampered with. Otherwise, and if the box has been tampered with before delivery, the Customer is required to not accept the package or accept it with reservations and to promptly notify the Customer by completing the form in the contact section of the Website.
I. RESPONSIBILITY
- PARUTTO COMMERCE SRL assumes no responsibility for disruptions attributable to force majeure such as accidents, explosions, fires, riots, strikes and/or lockouts, earthquakes, floods, damage to computer systems, system crashes, and other similar events that prevent, in whole or in part, the execution of the contract within the agreed timeframe;
- PARUTTO COMMERCE SRL will not be liable to any party for damages, losses and costs incurred as a result of the failure to execute the contract for the reasons mentioned above, the Customer being entitled only to a refund of the price paid;
- PARUTTO COMMERCE SRL is also not responsible for any fraudulent or illicit use that may be made by third parties of credit cards, checks, or other means of payment when paying for purchased products;
- In the event that the contract cannot be executed, even in part, due to unavailability of the goods or other causes of force majeure, PARUTTO COMMERCE SRL will notify the Customer by email within thirty days from the day the order is sent and will be released from all obligations, except for the reimbursement of any sums already paid by the latter;
J. WARRANTIES
- All products sold by PARUTTO COMMERCE SRL are covered by the manufacturer's standard warranty and the 24-month warranty for defects, pursuant to Legislative Decree no. 24/02. To benefit from warranty assistance, the Customer must retain the receipt received with the purchased goods;
- The manufacturer's standard warranty is provided according to the procedures illustrated in the documentation included in the product packaging. If, following intervention by an Authorized Service Center, the defect is found not to be covered by the manufacturer's standard warranty, the Customer will be charged for any inspection and repair costs requested by the Authorized Service Center, as well as any shipping costs incurred by PARUTTO COMMERCE SRL;
- The 24-month warranty pursuant to Legislative Decree no. 24/02 applies to products with a lack of conformity, provided that the product is used correctly, in accordance with its intended use and as provided in the accompanying technical documentation. This warranty, in accordance with Legislative Decree no. 24/92, is reserved only for private consumers (natural persons who purchase goods for purposes not related to their professional activity, or who make the purchase without indicating a VAT number on the order form). In the event of a lack of conformity, PARUTTO COMMERCE SRL will, at no cost to the Customer, restore the product's conformity through repair/replacement or a price reduction, up to and including termination of the contract;
- If, following intervention by an Authorized Service Center, no lack of conformity is found pursuant to Legislative Decree no. 24/02, the Customer will be charged for any verification and repair costs requested by the Authorized Service Center, as well as any transportation costs incurred by PARUTTO COMMERCE SRL;
- In the event that, for any reason, PARUTTO COMMERCE SRL is unable to replace a product under warranty (repaired or replaced), it may proceed, with the customer's consent, to replace the product itself (if still in the price list) or with another of equal characteristics and value or, finally, to issue a discount voucher for the same amount to be spent on another product valid for 6 months from the date of issue;
- No damages can be requested from PARUTTO COMMERCE SRL for any delays in carrying out repairs or replacements of products under warranty;
- In cases where the application of the warranty requires the return of the product, the item must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc.). To limit damage to the original packaging, we recommend, whenever possible, placing it in a second box. In all cases, the application of labels or adhesive tape directly on the product's original packaging should be avoided.
K. RIGHT OF WITHDRAWAL - ORDER CANCELLATION
- The right of withdrawal applies, in accordance with current legislation, only to natural persons (consumers) acting for purposes that can be considered unrelated to their professional activity. Therefore, purchases made by retailers, companies, and natural persons acting for purposes related to a professional activity are excluded from the right of withdrawal;
- Within the limits of the provisions of the previous paragraph, pursuant to art. 5 of Legislative Decree No. 185/1999, if the customer is a consumer (i.e., a natural person who purchases the goods for purposes not related to his or her professional activity, or does not indicate a VAT number in the order form to PARUTTO COMMERCE SRL), he or she has the right to withdraw from the purchase contract for any reason, without penalty and without prejudice to the provisions of point 3 below;

To exercise this right, the customer must send a "Purchase Withdrawal" request via email to shop@calzatureparutto.it in which it will be necessary to send photos of the defective product and also indicate the bank details necessary to return the sums paid; the PARUTTO COMMERCE SRL customer service will send the customer a paper form via email (also downloadable from the page

Upon receipt of the product, PARUTTO COMMERCE SRL will email the customer regarding the return request. The product must be returned to PARUTTO COMMERCE SRL within 10 days of authorization;

The right of withdrawal is however subject to the following mandatory conditions:
- The return must first be agreed with PARUTTO COMMERCE SRL
- the right applies to new, unused and non-customised products;
- Orders must NOT be placed for viewing or testing, otherwise the return must be made at *your own expense* and the refund will be made net of shipping costs upon receipt of the product;
- For product exchanges that are not due to size changes or defects (e.g. color or model changes), the shipping costs for the new goods are the responsibility of the customer;
- For returns to foreign countries, shipping costs for the new goods are the responsibility of the customer;
- The right applies to the product purchased in its entirety; it is not possible to exercise the right of withdrawal on only part of the purchased product (e.g. accessories, embroidery, etc.);
- The right of withdrawal is recognized only to natural persons, excluding therefore resellers or subjects who in any capacity purchase for resale to third parties;
- The purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories). To limit damage to the original packaging, we recommend, whenever possible, placing it in a second box, on which you should affix the return authorization code issued by PARUTTO COMMERCE SRL. Under no circumstances should labels or adhesive tape be placed directly on the product's original packaging.
- the item subject to the exercise of the right of withdrawal must bear the same serial number as that shown on the PARUTTO COMMERCE SRL sales document. If the item bears a serial number different from that indicated on the documents, the return will not be accepted and the product will be made available to the customer for its return, simultaneously cancelling the withdrawal request;
- the shipping costs for returning the goods are the responsibility of the customer;
- the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
- In the event of damage to the goods during transport, PARUTTO COMMERCE SRL will notify the customer of the incident (within 5 working days of receiving the goods in its warehouse), allowing the customer to promptly file a complaint with the courier of their choice and obtain a refund for the value of the goods (if insured). In this case, the product will be made available for return, simultaneously canceling the request for withdrawal.
- PARUTTO COMMERCE SRL is not responsible in any way for damage or theft/loss of goods returned via uninsured shipments;
- Except for any repair costs for verified damage to the original packaging, PARUTTO COMMERCE SRL will refund the customer the full amount paid within 30 days of receiving the returned goods. This refund will be issued via cash on delivery or bank transfer. In the latter case, the customer must promptly provide their bank details (IBAN) for the refund. Return shipping costs, if requested, will not be refunded.

The right of withdrawal lapses entirely, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where PARUTTO COMMERCE SRL ascertains:
- failure to affix the authorization form issued by PARUTTO COMMERCE SRL to the outer packaging of the shipped package;
- the lack of the external packaging and/or the original internal packaging;
- the absence of integral elements of the product (accessories, parts, etc.) or anomalies in the product itself;
- damage to the product for reasons other than its transport;
In the event of forfeiture of the right of withdrawal, PARUTTO COMMERCE SRL will return the purchased item to the sender, charging the latter the shipping costs.
- It is possible to cancel an order if it has not been processed. The customer can send an email to shop@calzatureparutto.it. If the status is open, it is considered not yet processed and only in this case can the customer cancel the order by promptly notifying the customer by email or by calling +39 388 903 1496. Subject to any administrative costs, PARUTTO COMMERCE SRL will refund the customer the amount already paid within 30 days of the return of the goods, by reversing the amount charged via cash on delivery or bank transfer. In the latter case, it is the customer's responsibility to promptly provide the bank details to which the refund should be sent (IBAN code).
L. CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE
PARUTTO COMMERCE SRL reserves the right to terminate the contract by simply notifying the customer with adequate and justified reasons. In this case, the customer will be entitled to a refund of any sums already paid.
M. PRIVACY, PROVISION AND PROCESSING OF PERSONAL DATA
The data provided by the Customer, required to fulfill the order, is processed in accordance with the provisions of EU Regulation 679/2016 ("GDPR") regarding the "Protection of Personal Data." For any further information, please consult the "Privacy Policy" section;
N. COMPLAINTS
Any complaints must be addressed to PARUTTO COMMERCE SRL Via Evangelista Torricelli 26 31021 Mogliano Veneto (TV), or by email to shop@calzatureparutto.it;
O. PROBLEMS RELATING TO VIEWING THE SITE
It is the Customer's responsibility to independently equip themselves with suitable equipment and programs to connect to the Internet. If the Customer is unable to view part or all of the Site, the Supplier cannot be held liable for any charges or liability;
P. SUSPENSION OF SERVICE
The Supplier reserves the right to suspend the visibility of the Site in all or even just part of its functions in relation to all needs related to its efficiency and security and, except for reasons of particular urgency, will provide notice of this to customers by any means deemed appropriate and as soon as possible;
Q. CONDITIONS
- The conditions contained in this document may be modified by PARUTTO COMMERCE SRL without prior notice and will be valid from the date of publication on the PARUTTO COMMERCE SRL circuit websites;
R. JURISDICTION AND APPLICABLE LAW
- The sales contract between the Customer and PARUTTO COMMERCE SRL is deemed to be concluded in Italy;
- Any dispute relating to the application, execution, interpretation and violation of purchase contracts stipulated "online" through the PARUTTO COMMERCE SRL website is subject to Italian jurisdiction and regulated by Italian law;
- For anything not expressly provided for herein, the legal provisions applicable to the relationships and situations envisaged by the legislation in force at the time of completion of the online sales contract shall apply;
- For any dispute concerning the validity, execution or interpretation of the contract and its effects, the Court of Treviso shall have exclusive jurisdiction;
Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the Customer declares to have carefully read all points of the General Conditions reported above and, after careful rereading, to expressly accept all points when registering for the service;
S. BRANDS AND LOGOS
Trademarks, logos, and other distinctive signs of any kind present on the site belong to their respective owners. The use of trademarks, logos, and other distinctive signs, including their reproduction on other websites by unauthorized third parties, is prohibited. The contents of the site (text, graphics, images, and animations) are protected by copyright; therefore, the reproduction of images and their publication in any form without the written authorization of PARUTTO COMMERCE SRL is prohibited. The contract does not grant the Customer any rights to trademarks, logos, and other distinctive signs of any kind present on the site, nor to their content;
T. COMMUNICATIONS AND CUSTOMER SUPPORT
All communications between the parties must be made in writing and sent to the address indicated, for PARUTTO COMMERCE SRL in these terms and conditions, and, for the Customer, in the order submitted by the Customer.
